Terms of Use for Village Legacy
1. Who we are and what this covers
Village Legacy ("the game") is a village-building game for smartphones and tablets, offered by ‹name or company, address› ("we"). Contact: , https://villagelegacy.de/support.
These terms apply to the game and all its online features (cloud save, community, mail, redeem codes, purchases). By playing you agree to them. The terms of the app store you downloaded the game from (Apple App Store or Google Play) apply as well.
How we handle your data is described in our Privacy Policy: https://villagelegacy.de/en/privacy.
2. Age
‹DEFINE THE AGE POLICY, aligned with the store age rating and section 8 of the Privacy Policy. E.g.: "If you are younger than ‹age›, you may use the game only with the consent of your parents or guardians, and purchases require their consent."›
3. Your game progress: device and recovery code
- There is no user account with a password. Your progress is tied to your device and backed up on our server.
- With the recovery code (under Settings → Transfer your save) you can move your progress to another device. Whoever has the code has the progress. Keep it safe and do not share it.
- If someone loads your progress onto their device with your code, we cannot tell whether it was you. We cannot be responsible for losses caused by you sharing or losing your code, unless we are at fault ‹legal review›.
- If you delete the app without noting the code, we usually can no longer find your progress. With your player ID (under Settings) support can try.
- Game progress is personal. You may not sell it or pass it on for money.
4. In-game currency and virtual items
- Gems, coins, charm, villagers, buildings, decorations and all other content in the game are virtual. You acquire no ownership of them, only a personal, non-transferable, revocable right to use them in the game.
- Virtual content has no monetary value. It cannot be exchanged for real money, paid out, sold or traded outside the game.
- We may change game values (e.g. in-game prices, rewards, wheel probabilities) to keep the game balanced. This does not take away gems you have already bought ‹legal review›.
- Wheels and similar random elements only award in-game content, never real money or physical prizes.
5. Purchases
- In-game purchases (e.g. gem packs, offers, "Ad-free") are made through Apple's App Store or Google Play. Payment, invoicing and refunds are handled by that store under its terms. You see the price in the store before buying.
- After the store confirms the purchase, our server checks the receipt and credits the content. If something does not arrive, contact support with your player ID.
- Purchased virtual content is non-refundable, except where the law or the store's rules provide for a refund. Refunds are requested from the store (Apple: reportaproblem.apple.com; Google: via Google Play).
- If a purchase is refunded or reversed, we may remove the content received with it ‹legal review; not technically implemented today›.
- "Ad-free" replaces the optional reward videos: you get the reward without a video. The daily limits on such rewards still apply.
5a. Right of withdrawal for digital content ‹LEGAL REVIEW›
‹Consumers in the EU generally have a 14-day right of withdrawal for distance contracts. For digital content not supplied on a tangible medium, it lapses if supply begins with your express consent before the period ends and you acknowledge that you thereby lose your right of withdrawal (§ 18(1)(11) FAGG, Art. 16(m) Consumer Rights Directive). To clarify:
- Whether Apple or Google act as the seller towards the customer (then their withdrawal and refund rules apply and this section only refers to them), or whether we are the contracting party.
- Whether the purchase flow in the game or the store obtains the required consent and acknowledgement; if not, add a notice to the purchase dialog.
- Wording of the notice.›
6. Advertising
The game shows only optional reward videos from Google AdMob. To get the reward you must watch the video to the end. We cannot guarantee that a video is available. Rewards are limited per day.
7. Community: rules for names and conduct
In the community, other players see your player name and the names and cards of your villagers. The following applies:
- No offensive, discriminatory, sexual, violence-glorifying, extremist or otherwise unlawful names — neither as player nor as villager name.
- No personal data: neither your own (real name, address, phone number, social media accounts) nor anyone else's.
- No advertising, no links, no invitations to make contact outside the game.
- No impersonation — in particular not of us, of support or of a well-known person.
- No harassment of other players, including by mass requests.
You can block and report players. We review reports and may — with or without a report — remove players who break these rules from the community: their name is reset and their villagers no longer appear in any list. For serious or repeated violations we may block access to online features entirely (section 8). We are not obliged to check all content in advance.
‹For moderation in the EU, check which obligations follow from the Digital Services Act (DSA), e.g. giving the affected player a statement of reasons and a complaint route.›
8. What is not allowed, and suspensions
In particular, it is not allowed to:
- manipulate, forge or reverse-engineer the game, the server or purchase receipts, except where the law expressly permits it;
- use cheats, bots, modifications or exploit bugs to gain an advantage — please report bugs you find to support;
- burden the server with automated requests or guess other players' recovery codes;
- sell or buy virtual content or game progress for money.
For violations we may — in proportion to their severity — issue a warning, remove unlawfully obtained content, remove you from the community, or temporarily or permanently block your access to online features (cloud save, community, mail). ‹Legal review of the procedure and hearing.›
9. Changes and discontinuation
- We keep developing the game and may change, add or remove content and features. Some features need an internet connection and a current version of the game.
- We may discontinue the game or individual online features. We will announce this in the game at least ‹e.g. 60 days› in advance. From the announcement on we will no longer offer purchases. ‹Legal review of whether and how unused purchased content is compensated.›
- We may change these terms. We will inform you of significant changes in the game in good time beforehand. ‹Legal review of the mechanism (consent vs. right to object).›
10. Availability
We aim to keep the game and server available at all times but cannot guarantee it. Maintenance, outages or events beyond our control may interrupt online features temporarily.
11. Liability ‹TO BE WRITTEN BY A LAWYER›
‹Placeholder. Typical content, only partly permissible towards consumers:
- Unlimited liability for intent and gross negligence and for personal injury.
- For slight negligence, liability only for breach of essential obligations and limited to foreseeable, typical damage — under Austrian law (§ 6(1)(9) KSchG) only partly possible towards consumers.
- Statutory warranty rights (VGG for digital services) remain unaffected.›
12. Governing law and jurisdiction ‹LEGAL REVIEW›
‹Placeholder, e.g.: Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and conflict-of-law rules. For consumers this choice of law applies only insofar as it does not deprive them of the protection of the mandatory provisions of their country of residence. Jurisdiction for consumers: ‹…›. Reference to the EU online dispute resolution platform or Verbraucherschlichtung Austria ‹check whether still required›.›
13. Final provisions
If any provision of these terms is invalid, the remaining provisions remain in effect. ‹Legal review.›
